2. Scope
These Terms govern ENRIVAQ, including platform access, API/file input, product-data processing, content generation, billing and related services.
They apply to business customers and consumers. Mandatory consumer law remains unaffected.
3. Service
ENRIVAQ is an AI-assisted product-data enrichment service.
Depending on scope, functionality may include product input, identification, public-source research, attribute extraction, normalization, classification, validation, product descriptions, titles, SEO metadata, category content and configured output.
The functions included for a customer are defined by the agreed processing scope, quote or Order Form.
4. Review responsibility
AI-assisted results may be incomplete or wrong.
Customers must appropriately review critical technical, safety-related, regulated or purchasing-relevant data before publication or use.
ENRIVAQ is not a certification, legal, tax or product-safety service.
5. Contract formation
A contract may be formed through paid online ordering, an Order Form, an accepted offer or another documented agreement.
Consumers receive legally required pre-contract information before a paid online order.
Consumer checkout must comply with Section 312j BGB.
6. Account
Users must provide accurate information and protect credentials.
Fairtech Group may require MFA or other security measures.
7. Pricing and VAT
ENRIVAQ does not use a public standard rate card. The applicable price is the customer-specific price provided after catalog assessment and stated in the authenticated customer workspace, accepted offer, Order Form or invoice.
The confirmed product volume is the primary commercial pricing input. Larger confirmed processing volumes may receive a lower unit price.
Consumer prices include applicable VAT where legally required. Business prices may be shown net where clearly identified.
8. Catalog quote and volume pricing
ENRIVAQ uses customer-specific catalog pricing. After the processing scope has been assessed, the customer receives a private per-product price for the confirmed product volume and agreed outputs.
Higher confirmed processing volumes may receive a lower unit price. Exact rates and internal volume bands are not part of the public website.
The customer-specific quote, accepted offer or Order Form defines the applicable volume, unit price, included outputs and any separately scoped implementation work.
A material change in catalog volume or processing scope may require a revised quote.
9. Payments
Payment may be made via Stripe, bank transfer or another offered method.
The applicable payment schedule and payment conditions are stated in the customer-specific quote, Order Form or invoice. Invoices are normally due within 14 days unless otherwise stated.
A catalog quote does not create an automatic subscription or automatic renewal unless recurring processing has been expressly agreed.
10. Refunds
Amounts paid for processing already properly provided are generally non-refundable unless mandatory law, billing error or service fault requires otherwise.
If advance payment has been expressly agreed, treatment of any unused amount is governed by the applicable quote, Order Form, payment-provider rules and mandatory law.
Consumer rights remain unaffected.
11. Pilots
A representative pilot or sample evaluation may be agreed individually. Its scope, sample, acceptance criteria, duration and any commercial terms are defined in the applicable offer or Order Form; no public pilot rate applies.
12. Customer obligations
Customers must have lawful rights to process submitted data, respect third-party rights, not bypass technical restrictions unlawfully, not misuse third-party credentials, not upload unlawfully obtained personal data or special-category data without agreement, and review critical output.
13. Public-source research
ENRIVAQ may research publicly available product information where technically and legally permitted.
Public availability does not automatically grant reuse rights in protected text, images or databases.
Customers remain responsible for lawful downstream use.
14. Customer Data
Customers retain rights in Customer Data and grant Fairtech Group the rights necessary to provide the service.
The DPA applies where Fairtech Group acts as processor.
15. Output
After payment, customers may use output subject to law and third-party rights.
To the extent transferable rights arise in customer-specific output, Fairtech Group grants or transfers them on a perpetual basis where legally possible.
Fairtech Group retains rights in the platform, software, architecture, general methods, documentation and pre-existing components.
AI output is not guaranteed to be unique or copyrightable.
16. Anonymized operational metrics
Fairtech Group may use aggregated, irreversibly anonymized metrics for security, performance, capacity and product improvement where they cannot identify a customer, person or specific catalog.
Customer Data is not used for general-model training without a separate explicit agreement.
17. Availability
No guaranteed SLA applies unless expressly agreed.
Maintenance, security measures, provider outages and force majeure may affect availability.
18. Changes
Functionality may evolve for technical, legal, security or product reasons.
Mandatory consumer rights remain unaffected.
19. Warranty
Statutory warranty rights apply. Mandatory consumer rights for digital products are not limited by these Terms.
20. Liability
Fairtech Group has unlimited liability for intent, gross negligence, death/personal injury, mandatory product liability, express guarantees and other mandatory liability.
For ordinary negligence, liability is limited where legally permissible to breach of essential contractual duties and foreseeable typical loss.
21. Suspension
Accounts/jobs may be suspended for unlawful use, material security risk, abuse, non-payment or serious breach.
22. Term and termination
Unless an Order Form states a fixed term, either party may generally terminate with 30 days’ notice.
Termination for cause remains available.
Where Section 312k BGB applies, the legally required online termination function must be provided.
23. Data after termination
A customer may request an available export for up to 30 days. Deletion then follows the Privacy Policy and DPA.
24. Consumer withdrawal
Consumers generally have a 14-day statutory withdrawal right for distance contracts unless a statutory exclusion/expiry condition applies.
Withdrawal instruction
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date the contract is concluded.

Where Section 356a BGB applies, the legally required online withdrawal function is additionally provided.
If you expressly request paid services to begin during the withdrawal period, statutory compensation may be due for performance provided before withdrawal where legal requirements are met.
Early expiry occurs only if all statutory conditions are satisfied.

25. Consumer ADR
Fairtech Group is currently neither obliged nor willing to participate in consumer ADR proceedings unless a specific legal obligation applies.
The former EU Online Dispute Resolution platform is no longer used.
26. Privacy
See the Privacy Policy and DPA where applicable.
27. Amendments
Amendments affecting existing contracts are made only where legally valid.
28. Governing law
German law applies, excluding the CISG, where legally permitted.
Consumers retain mandatory protections of the law of their habitual residence.
29. Jurisdiction
For merchants and public-law entities, venue is Fairtech Group’s place of business where legally permissible.
Consumer venue is governed by mandatory law.
30. Language
The German version is canonical. This English version is for convenience.
